Acceptance of terms
By accessing or using TAMCO (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service. The Service is intended for use by employed or contracted personnel of organisations that have engaged TAMCO to manage their field service operations.
Accounts and access
Your account is issued by your organisation's administrator. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
You agree to:
- Provide accurate and current information when prompted;
- Notify us immediately of any unauthorised access to your account;
- Not share your account credentials with any other person;
- Use the Service only for the purposes authorised by your organisation.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws;
- Interfere with, disrupt, or attempt to gain unauthorised access to the Service or any related systems;
- Reverse engineer, decompile, or attempt to extract the source code of the Service;
- Upload or transmit any malicious code, viruses, or harmful content;
- Use the Service to harass, defame, or harm any individual or organisation;
- Resell, sublicense, or otherwise transfer your access to the Service without our consent.
Your content
You retain ownership of any data, photos, signatures, reports, and other content you submit through the Service ("Your Content"). By submitting content, you grant TAMCO a limited licence to host, store, and process Your Content solely for the purpose of providing the Service to you and your organisation.
You are responsible for the accuracy and legality of Your Content and for ensuring you have the rights to submit it.
Intellectual property
The Service, including all software, designs, text, graphics, logos, and trademarks, is owned by TAMCO or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
Fees and billing
Use of the Service is subject to the commercial agreement between TAMCO and your organisation. Individual end users (technicians, administrators, and contractors) are not charged directly unless otherwise stated.
Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have breached these Terms or if your organisation's agreement with us ends.
On termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will do so.
Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
Limitation of liability
To the maximum extent permitted by law, TAMCO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Indemnification
You agree to indemnify and hold TAMCO harmless from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
